UN Experts Warn Over Council of Europe Migration Deal
In a written statement issued Tuesday, the experts stressed that migration policies must continue to be guided by international human rights principles.
“Migration governance must remain grounded in human rights. Border management cannot come at the expense of the prohibition of torture, ill-treatment and other serious harms, effective remedies, and non-discrimination,” the experts said in a written statement.
According to reports, the declaration was adopted in May with the stated aim of clarifying the application of the European human rights framework in migration-related matters while reaffirming the authority of states to manage and secure their borders.
However, critics argue that the measure could encourage a differentiated approach to rights protections and place additional pressure on courts to adopt narrower interpretations of existing legal safeguards for migrants.
The experts noted that recent political efforts to reshape the balance between migration control and obligations under the European Convention on Human Rights risk fostering restrictive readings of state responsibilities and normalizing practices that may undermine fundamental rights.
“We are disappointed that the Declaration materialises concerns we previously raised, including the prioritisation of coercive migration control, restrictions on access to asylum, expanded detention and returns, the weakening of due process, and other actions that could lead to death, torture, ill-treatment, enforced disappearance or persecution of migrants,” the experts said.
According to reports, the experts warned that policies focused primarily on enforcement and deterrence could have serious consequences for vulnerable individuals seeking protection and urged European governments to ensure that migration management remains fully consistent with human rights obligations.
